General terms and conditions of the online shop of Atelier Walter Oczlon, Hauptstraße 34, 5600 St. Johann im Pongau, Austria.
1. Scope
The general terms and conditions listed below apply to the business relationships between the online shop operated by Atelier Walter Oczlon and the person ordering goods (hereinafter: customer) in the version valid at the time of the respective order.
2. Conclusion of contract
2.1 The presentation of the goods on the Internet does not constitute a binding offer, but rather merely an invitation to make an offer to Atelier Walter Oczlon. Only by ordering the goods does the customer submit a binding offer, receipt of which Atelier Walter Oczlon confirms electronically. This confirmation of receipt does not constitute acceptance of the contract. The contract is concluded when Atelier Walter Oczlon accepts the order by sending the ordered goods.
2.2 The contract language is German.
2.3 Atelier Walter Oczlon can refuse to accept orders without giving reasons and has the right to withdraw from the contract in the event of typographical, printing and calculation errors.
3. Revocation
3.1 Customers who are consumers within the meaning of the Consumer Protection Act can revoke their contractual declaration within 14 days in text form or by returning the goods. It is sufficient if the declaration of withdrawal is sent within the deadline without giving reasons.
3.2 Consumers do not have the right of withdrawal if the goods ordered are not received

3.5 Once the returned goods have been received by Atelier Walter Oczlon, any purchase price already paid will be refunded, less the shipping costs stated on the invoice. However, if there are visible signs of use, damaged packaging, missing parts or accessories or if the fee for returning the goods has not been paid, an appropriate fee for the use or reduction in value as well as any freight and storage costs incurred will be charged or retained.
4. Retention of title
4.1 The goods remain until the purchase price, including all additional fees, has been paid in full

5. Prices, payment terms
5.1 The prices at the time of the order apply. All prices are in euros (€) including VAT plus shipping costs (see section 6). Atelier Walter
In the case of successive delivery contracts, Oczlon is entitled to charge the additional amount if the VAT increases after the contract has been concluded.
5.2 Orders from and requested deliveries to EU countries, excluding Austria and Germany, as well as to third countries will only be carried out against advance payment.
5.4 To protect against credit risk, certain payment methods can be excluded in individual cases and deliveries can only be made against advance payment.
6. Shipping costs
6.1 The delivery and shipping costs include the costs of packaging and shipping and vary depending on the recipient country. Please see the current shipping costs when ordering.
7. Delivery
7.1 Delivery of goods normally takes place within 7 working days of the customer's order, but in any case within 30 days of the order date.
7.2 Delivery is made at the customer’s expense and risk. Claims for damages due to late delivery or withdrawal from the contract are excluded in any case. The risk of loss and deterioration passes to the customer upon dispatch of the goods (i.e. handover to the delivery/transport facility) by Atelier Oczlon.
7.3 Delivery is made to the address specified by the customer. If the customer provides incorrect, incomplete or unclear information, he will bear all resulting costs.
8. Warranty/Liability
8.1 To the extent that Atelier Walter Oczlon is responsible under the above conditions or mandatory law, Atelier Walter Oczlon is only liable for property damage and financial loss in the event of intent or gross negligence.
9. Data protection
9.1 The customer's personal data will only be collected, processed and used within the framework of the legal regulations on data protection and to the extent that they are necessary for the establishment, content or change of the contractual relationship. They are used exclusively to process business with the customer and for accounting and customer records. The data transmitted to Atelier Walter Oczlon by the customer will be stored electronically for these purposes, but will not be passed on to third parties. If the customer is a consumer, Atelier Oczlon will, upon request, provide the customer with information about the data stored about him or her at any time and free of charge and, upon request, delete it, correct it and block it for advertising and marketing purposes.
10. Copyright
10.1. All photographic, graphic and conceptual services are protected by copyright.
10.2. The Austrian copyright laws apply as the basis for the contract.
11. Final provisions
11.1. The law of the Republic of Austria applies. The application of the UN Convention on Contracts for the International Sale of Goods of April 11, 1988 is excluded.
11.2. Changes or additions to these terms and conditions in writing. This also applies to the cancellation of this written form requirement.
11.3. The exclusive place of jurisdiction is Salzburg if the customer is an entrepreneur within the meaning of the German Commercial Code (UGB) or a corporation under public law. The same applies if the entrepreneur does not have a general place of jurisdiction in Germany or moves his place of residence abroad after the contract has been concluded or if his place of residence is not known at the time the action is filed.
11.4. If individual provisions of this contract are ineffective or contradict the legal regulations, this will not affect the rest of the contract.
